Lilly Agrees to Settle Majority of Zyprexa(R) Product Liability Litigation
Eli Lilly and Company - the maker of the medication Zyprexa - announced on June 9 that it has entered into an agreement in principle with plaintiffs' attorneys involved in liability litigation to settle a majority of the claims against the company relating to side effects of the drug.
Zyprexa is an atypical antipsychotic prescription drug used to help manage symptoms of schizophrenia, the manic phase of manic-depression, and other psychotic disorders. While this new class of drugs was heralded from the onset because they differed from first generation antipsychotics by blocking certain neurochemical reactions within the brain, effectively alleviating the drug's side effects, Zyprexa ultimately was found to alter the metabolism of some patients and reducing the body's
sensitivity to insulin in others, leading to serious and sometimes fatal blood-sugar conditions.
According to the agreement, Lilly will establish a fund not to exceed $690 million for plaintiffs who agree to settle their claims. The settlement fund will be overseen and distributed by claims administrators appointed by the plaintiffs' steering committee. At this time, the exact number of claimants covered by this settlement is unknown, but is estimated to be 8,000, comprising approximately 75 percent of claims identified to Lilly.
