Divorce is a complicated and sensitive subject regardless of your home state. Lawmakers in Oklahoma created two relatively simple distinctions to help people through these difficult times to take the appropriate action in order to remedy their relationship difficulties. Our attorneys understand that objective, experienced, and sensitive counsel can relieve much of the worry and frustration of a divorce, and Atkins & Markoff can help to pacify your fears and answer your questions.

The first option for people seeking legal divorce in Oklahoma is the limited divorce. Similar to a trial separation in other states, limited divorce removes the right for the parties to cohabitate but does not otherwise affect legal status. The husband and wife are still married in the eyes of the law, and the momentary respite from each other can sometimes even lead to reconciliation.

If the two parties are set on divorce and cannot reconcile, they can pursue the second option, which is called an absolute divorce. This condition arises from marital misconduct or statutory cause that interferes with a healthy relationship. This action legally dissolves a marriage past the point of recovery and terminates the relationship. The only stipulation is that the participants must remain residents of Oklahoma for six months for the divorce to take effect.

Oklahoma was the first state to enact the “no-fault” divorce. A no-fault divorce is a way for two people to end a marriage without the potentially embarrassing public declaration of why a relationship failed. People could only get divorces if one party committed one of several offenses, but the new law eliminated this aspect of the legal proceedings. This small bit of privacy alleviated some of the anxiety for people seeking divorces.
